¶1 Paul L. Powers appeals from a judgment of conviction for operating a motor vehicle while intoxicated (OWI) and operating with a prohibited alcohol concentration (PAC), both as fourth offenses. He contends that the circuit court erred when it denied his motion to suppress his breath test results. He asserts that the arresting officer violated the implied consent law by marking Powers' refusal as consent and proceeding with the breath test. In the alternative, Powers argues that the accuracy of the test result was not sufficiently established by the State. We disagree with Powers' arguments and conclude that the circuit court's evidentiary holdings were proper. Accordingly, we affirm the judgment of conviction.
